1. Acceptance of Terms

By accessing or using HarmonyWithin ("the Service"), you agree to be bound by these Terms of Use. If you do not agree with these terms, please do not use our Service.

2. Important: Not a Substitute for Professional Care

HarmonyWithin is an AI companion for emotional support and self-help — it is NOT a replacement for professional mental health treatment, therapy, or medical advice.

  • HarmonyWithin does not provide medical diagnosis
  • HarmonyWithin does not provide professional therapy or counseling
  • HarmonyWithin is not staffed by licensed mental health professionals
  • The AI companion is a self-help tool, not a clinician

If you are experiencing a mental health condition, please consult a licensed mental health professional in your area.

3. Crisis Situations

HarmonyWithin is NOT designed for crisis intervention. If you or someone you know is in immediate danger or experiencing a mental health crisis:

4. Use at Your Own Risk

You use HarmonyWithin at your own risk and discretion. While we strive to provide helpful and supportive AI responses, we cannot guarantee:

  • The accuracy or appropriateness of AI-generated content
  • That the Service will meet your specific needs
  • That the Service will be available without interruption

HarmonyWithin and its creators are not liable for any decisions you make based on interactions with the AI companion.

5. Data & Privacy

Your use of HarmonyWithin is also governed by our Privacy Policy. Key data principles:

  • Local-first storage: Conversations, mood data, journal entries, and ritual data are stored on your device using browser localStorage — they never leave your device unless you explicitly choose otherwise.
  • Anonymous by design: No account, no name, no email required to use the app. We do not track individual users.
  • AI processing: When you send messages, they are processed through the OpenAI API with zero data retention enabled. This means OpenAI does not store your messages and does not use them for model training.
  • Anonymized analytics: We use Cloudflare Web Analytics for privacy-friendly traffic insights. No tracking cookies, no personal identifiers.
  • No data selling: We never sell, share, or monetize your personal data.

6. Acceptable Use

You agree NOT to:

  • Use the Service for any illegal purpose
  • Attempt to harm, abuse, or exploit the AI system
  • Share harmful, abusive, or illegal content
  • Attempt to reverse-engineer or copy the Service
  • Use the Service to generate content that violates others' rights
  • Attempt to bypass usage limits or access controls

7. Intellectual Property

The HarmonyWithin name, logo, website design, and AI system are the intellectual property of NoirProtocols. You may not copy, modify, or distribute our content without permission.

8. Premium Subscriptions & Payments

HarmonyWithin offers Premium access through payments processed securely via Stripe.

  • Payment Processing: All payments are handled by Stripe. We do not store your credit card details on our servers.
  • Activation Codes: After successful payment, you receive an activation code instantly on-screen and via email.
  • Duration: Premium access is valid for the purchased period (e.g., 30 days) from the date of activation.
  • Non-Transferable: Activation codes are linked to your device(s) and should not be shared publicly.
  • Multiple Devices: Each code can be activated on up to 5 devices.

9. Refund Policy

We want you to be satisfied with your HarmonyWithin experience:

Premium Access Codes

  • 7-Day Satisfaction Guarantee: Request a full refund within 7 days of purchase, no questions asked.
  • After 7 Days: Refunds are considered on a case-by-case basis at our discretion.

How to Request a Refund

Email us at info@harmonywithin.bot with your email address and purchase date. Refunds are typically processed within 5-10 business days.

Non-Refundable Situations

  • Requests made more than 30 days after purchase
  • Promotional or gifted access codes
  • Accounts terminated for Terms of Use violations

10. Limitation of Liability

To the maximum extent permitted by law, HarmonyWithin and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

11. Changes to Terms

We may update these Terms of Use from time to time. Continued use of the Service after changes constitutes acceptance of the new terms.
